ITEM NUMBER FOUR. DISCUSSION IN ACTION CONSULTING, LLC AND HCDC SERVICES AGREEMENT. ON A MOTION TO AUTHORIZE THE EXPENDITURE OF $42,500 BY THE HORIZON ECONOMIC DEVELOPMENT CORPORATION TO ENGAGE PETTIT CONSULTING, LLC TO ASSIST IN THE CREATION OF A TAX INSTRUMENT REINVESTMENT TAX INCREMENT REINVESTMENT ZONE. OKAY. THANK YOU, MR. BOARD. THANK YOU. YOUR PATIENCE TONIGHT. SO ITEM NUMBER FOUR ON TONIGHT'S AGENDA IS A REQUEST TO THE EXECUTIVE DIRECTOR OF THE HORIZON ECONOMIC DEVELOPMENT CORPORATION TO AUTHORIZE TO SIGN A CONSULTING SERVICE AGREEMENT BETWEEN THE HSC AND PETTIT CONSULTING, LLC IN AN AMOUNT NOT TO EXCEED $42,500, AND SO ON. THE NEXT SLIDE, WHICH YOU WILL SEE IS SOME BACKGROUND ON THE PROJECT.

SO YOU ALL MIGHT REMEMBER THAT WE'VE SPOKEN ABOUT THIS BEFORE. SO THE HDC AND THE CITY HAVE DETERMINED THAT EXPANDING THE EXISTING TOURISM. SO YOU ALL MAY KNOW THAT THE TAX WHEN I SAY TOURISM, IT'S TAX INCREMENT REINVESTMENT ZONE. IT'S A SPECIAL ZONE THAT WE HAVE IN TOWN. IT'S MEANT TO STIMULATE DEVELOPMENT. IT'S ONE OF THE MOST POWERFUL ECONOMIC DEVELOPMENT TOOLS THAT ANY CITIES CAN HAVE. AND WE'VE GOT ONE IN TOWN. IT'S ACTUALLY COVERING THE TRANSIT ORIENTED DEVELOPMENT RIGHT HERE NEXT TO US. SO IT'S CALLED TOURS ONE.

SO IF I REFER IF I REFERENCE TOURS ONE, THAT'S WHAT I'M TALKING ABOUT. SO THE INTENT IS TO EXPAND THIS EXISTING TOURS TO PULL IN WHAT WILL BASICALLY BE A WHOLE BUNCH OF NEW TAX REVENUE THAT WILL BE GENERATED BY THE DEVELOPMENT THAT'S SCHEDULED TO BE BUILT IN NORTHEAST HORIZON CITY. YOU ALL MAY REMEMBER WHAT THAT IS. A FEW SLIDES DOWN, YOU'LL SEE AN IMAGE OF WHAT THAT IS KIND OF DESCRIBING IT. BUT THE REQUEST HERE WOULD BE TO ALLOW US BASICALLY TO CONTRACT WITH A VERY QUALIFIED TOURIST CONSULTANT TO GET THE WHOLE PROCESS STARTED, FROM RUNNING THE NUMBERS, TO SEE WHAT THAT WOULD LOOK LIKE, TO ACTUALLY AFFECTING THE TOURISM EXPANSION. AND SO STAFF DID IDENTIFY THE NEED TO ENGAGE WITH A QUALIFIED TOURS CONSULTANT TO GENERATE REVENUE ESTIMATES, WHICH WILL ALLOW THE CITY TO TAKE THE NEXT STEPS IN CONSIDERING WHICH ASPECT OF THE PLAN, WHICH ASPECTS OF THE PLAN ARE VIABLE AND BENEFICIAL TO THE LARGER DEVELOPMENT STRATEGY. AND WE'RE ALSO TALKING ABOUT SPURRING DEVELOPMENT NOT ONLY IN THE STORE, BUT THE SPORTS PARK AS WELL. SO YOU ALL MAY REMEMBER THAT THE 2020 HORIZON CITY COMP PLAN IDENTIFIED A SPORTS PARK AS ONE OF THE MAJOR PROJECTS THAT WE WANTED TO BUILD. WE'VE RUN THROUGH THE FEASIBILITY STUDY IN 22 THAT CAME OUT LOOKING GOOD. SO WE NOW WE'RE AT THE POINT OF TRYING TO FIGURE OUT WHO THE PRIVATE PARTNER OR WHATEVER PARTNER WAS GOING TO DANCE TO THIS, BASICALLY AND FIGURE OUT THE FINANCING. SO WE THINK WE'VE GOT A PLAN HERE, BUT ONE OF THE MAIN ASPECTS OF THE PLAN WOULD DEFINITELY BE TO EXPAND THE TOURS TO ALSO SUPPORT THE DEVELOPMENT OF THE SPORTS PARK.

SO AGAIN, WE'VE GOT A TOURS HERE. THE INTENT WOULD BE TO WORK SOME NUMBERS OUT WITH THE CONSULTANT TO SEE IF IT'S BENEFICIAL TO THE TO OUR PRIVATE DEVELOPER PARTNER AND TO THE CITY TO PULL THIS TOURISM ENERGY AND BRING THE DEVELOPMENT TAX REVENUES TO HELP STIMULATE THE CITY. AND THEN ALSO THE SPORTS PARK. YOU KNOW, JUST SHOW THEM WHAT'S LIKE DRAWN ON YOUR DAY. DEFINITELY. SO SO I'M STILL ON SLIDE NUMBER THREE BOARD. SO ON PAGE THREE. AND SO WHAT YOU WILL SEE RIGHT NOW IS THAT FIRM. AND OUR REQUEST TO FOR YOU ALL TO

ALLOW US TO TO CONTRACT WITH THEM. THE NEXT SLIDE, SLIDE NUMBER FOUR ON PAGE TWO IS JUST AN IMAGE TO KIND OF REMIND YOU ALL OF WHERE THE PROPOSED SPORTS PARK IS SET TO. AND AS YOU CAN SEE, THAT'S SORT OF THE EASTERN PART. IT IS THE EASTERN PART OF TOWN RIGHT NEXT TO THE HIGH SCHOOL. AND IT'S INITIALLY CONCEIVED AS A 30 ACRE SPORTS PARK, BUT THERE'LL BE A LOT OF OTHER DETAILS THAT WE'LL BE BRINGING FORWARD TO YOU PRETTY SOON THAT THAT MAY CHANGE THAT.

SO I'M FLIPPING THE PAGE OVER TO PAGE NUMBER FIVE NOW. SLIDE NUMBER FIVE I'M SORRY, PAGE THREE. AND SO THIS AGAIN IS JUST TO TO GIVE YOU A SENSE OF WHERE EVIDENCIA IS. THAT'S THE IMAGE THAT YOU SEE ON THE RIGHT SIDE OF THE SLIDE. BUT WE DID CONDUCT A SEARCH. WE, WE SEARCHED THROUGHOUT TEXAS AND WE WE IDENTIFIED THREE QUALITY FIRMS THAT WE CONSIDERED AS PART OF THIS PROCESS. AND SO THE PRIMARY FACTORS, AS YOU CAN SEE, LISTED THAT WE DID CONSIDER IN SELECTING CONSULTANT WERE FIRST AND FOREMOST FAMILIARITY WITH THE LOCAL DEVELOPMENT MARKET. THAT'S VERY IMPORTANT BECAUSE WE STILL HAVE TO MAKE SURE THAT WE GET THE RIGHT NUMBERS AND AND SEND THOSE OVER TO OUR PRIVATE PARTNER, OUR FINGERS CROSSED PRIVATE PARTNER. AND THAT'S REALLY THE MOST IMPORTANT PART. WE WANTED TO SEE IF THESE CONSULTANTS UNDERSTOOD LOCAL DEVELOPMENT AND WERE ABLE TO MORE OR LESS ACCURATELY PREDICT WHAT THE DEVELOPMENT WAS GOING ON FOR, LIKE WHAT IT WAS GOING TO BE WORTH FIVE YEARS FROM NOW, TEN YEARS, 15, 20 YEARS FROM NOW. SO THAT WAS JOB ONE. SECONDLY, WE WANTED TO MAKE SURE THAT THEY WERE ABLE TO DELIVER THE INFORMATION QUICKLY, BECAUSE WE'RE ALSO MOVING AT THE SCHEDULE OF OUR POTENTIAL PARTNER, AND THEY'RE MOVING VERY QUICKLY. IN FACT, IN JANUARY, THEY ALREADY START MEETING WITH THEIR LEADERSHIP TO SEE IF THIS IS DOABLE FOR THEM. THEY NEED NUMBERS ALREADY JANUARY, FEBRUARY. SO WE WANTED TO MAKE SURE THAT THEY COULD MOVE QUICKLY WITH US. AND FINALLY, WE ALSO WERE CONSIDERING COMPETITIVE PRICING. NOW THAT WASN'T THE PRIMARY PART, BUT WE DEFINITELY WANTED TO MAKE SURE THAT THAT'S SOMETHING WE CONSIDERED. AND SO THE THREE FIRMS THAT WE CONSIDERED WERE EARL AND ASSOCIATES HEADED AND AIDA AND CPXP. AND NOW I'M JUMPING OVER TO SLIDE NUMBER SIX ON PAGE THREE. AND THIS GIVES YOU A SENSE OF WHAT EACH OF THOSE FIRMS CAME THROUGH WITH IN TERMS OF THE THE ASPECTS THAT I JUST MENTIONED THAT WE WERE CONSIDERING. AND SO AS YOU CAN SEE, THE THE COMPANY THAT HAS THE MOST EXPERIENCE FOR IN A WAY WAS PETITE AND THEY WORKED WITH THE CITY. I THINK THEY'VE PUT TOGETHER SOME ABOUT 6 OR 7 OF THEIR TOURS VERY SUCCESSFULLY. THOSE ARE RUNNING VERY WELL RIGHT NOW. THE OTHER TWO COMPANIES DIDN'T HAVE ANY LOCAL AS AS WE STARTED TALKING ABOUT WE DIDN'T HAVE ANY LOCAL TOURS EXPERIENCE. THEY'VE DONE THIS BEFORE, BUT NOTHING NEAR EL PASO. SO THAT GAVE A CLEAR ADVANTAGE. THEY ALSO IT WAS ALSO ABLE TO PRODUCE THE THE NUMBERS THAT WE NEEDED WITHIN 2 TO 3 MONTHS, WHICH ERLBAUM ASSOCIATES WAS ALSO ABLE TO DO. THE TSP WASN'T THEY. THEY NEEDED ABOUT FIVE MONTHS. AND SO AND THE FINAL THING WAS THE PRICING. YOU CAN SEE TSP WAS ABOVE EVERYONE ELSE. SO THAT SORT OF BASICALLY CANCELED THEM OUT. AND IT LEFT PETITE AND EARL. AND WITH THE CASE BEING THAT PETITE AYALA ARE MUCH MORE EXPERIENCED AT CREATING TOURS LOCALLY, THEY DID COME OUT WITH A HIGH SCORE. AND SO THE HECK DOES IS IRON OUT A CONTRACT WITH KETTNER CONSULTING TO EXECUTE A SERVICE AGREEMENT, AND IT WILL BE NOT TO EXCEED $42,500, WHICH WILL BE COMING OUT OF THE HDC'S FUNDS. SO THE HDC WILL BE PAYING FOR THAT.

AND THIS WILL BE AGAIN THE FIRST STEP, BECAUSE WE HAVE TO GET WITH THEM, PROVIDE ALL THE DETAILS THAT THEY NEED, HAVE THEM TALK TO OUR PRIVATE PARTNERS, MAKE SURE THAT THEY CRUNCH THOSE NUMBERS, AND THEN GET BACK TO US WITH AN ACCURATE ANALYSIS AND LET US KNOW WHAT THOSE NUMBERS LOOK LIKE. WE THEN WILL MOVE THOSE NUMBERS ONTO OUR PARTNERS DESK. THEY WILL REVIEW THAT TO SEE IF THAT'S A DEAL THAT WORKS FOR THEM. AND THEN WE CAN PROCEED WITH HOPEFULLY SIGNING AN INCENTIVE THAT, AGAIN, WILL HELP STIMULATE THE SPORTS PARK DEVELOPMENT AND PRINCIPALLY EARLY FOR FOR THIS ITEM. AND SO THE REQUESTS AGAIN WOULD BE THAT YOU ALL DO ALLOW OUR EXECUTIVE DIRECTOR TO SIGN THE CONSULTING AGREEMENT WITH FOR AN AMOUNT NOT TO EXCEED $42,500. AND THAT'S THE PRESENTATION. TO ME THAT CREATION OF THAT TRS IS STILL SHOULD BE A VIABLE, EVEN IF WE DIDN'T HAVE THOSE PARTNERS. SO IS THAT ANALYSIS ALSO PART OF OF THIS SCOPE OF WORK? CAN THEY GIVE US AN AN ANALYSIS THAT SAYS, OKAY, THE COUNTY AND THE MUD DON'T WANT TO DO THIS? WHAT'S IT GOING TO BE IF WE DO IT ON OUR OWN? ABSOLUTELY. SO WE MENTIONED THAT OPTION TO THEM. WE TOLD THEM WE'VE GOT SOME OTHER TAXING ENTITIES THAT ARE PARTNERS, BUT THAT MAY BE THE CASE THAT WE WOULDN'T WANT TO BE SLOWED DOWN. IF THEY DON'T WANT TO JOIN US. WE DON'T WANT TO STOP THE TRAIN FROM MOVING. AND SO THEY'LL BE RUNNING OUT AS WELL. SO WE MIGHT BE LOOKING AT THE CREATION OF A SEPARATE TRC THAT'S JUST SOLELY CITY CITY RUN. IT LIKELY WOULD BE WALTER. AND HERE FOR THE FOR THE SAKE OF BEING ABLE TO HELP STIMULATE THE TOD DEVELOPMENT, WE'D PREFER TO TRY TO EXPAND THIS ONE TO PULL ALL THE MONEY TOGETHER. REALISTICALLY, WE PROBABLY WOULD ASK THAT THE LOCAL PARTNERS DISCONTINUE THE RELATIONSHIP OUT HERE SO THAT WE COULD PROCEED WITH WITH THE MONEYS THAT WE'VE GOT OUT THERE. BUT AGAIN, THAT'S THAT'S MORE OF A QUESTION FOR LEADERSHIP. THEY'LL GET THE CONSULTANT WILL GIVE US SCENARIOS AND THEN WE CAN BRING THEM TO YOU ALL AND SEE WHAT YOU PREFER. ONE OF THOSE SCENARIOS SHOULD BE THAT IT BE CREATED IF, IF, IF THERE IS RELUCTANCE ON OUR OTHER PARTNERS, WHICH I HOPE THERE IS NOT, I HOPE WE CAN JUST CONTINUE ON. BUT IT'S VERY IMPORTANT THAT I GET THIS OUT, BECAUSE I NEED TO GET THAT ANALYSIS BACK FROM DAVID TO SEE WHAT THOSE VALUATIONS ARE GOING TO LOOK LIKE, BECAUSE I'M LOOKING AND WE HAVE A POTENTIAL PARTNER OUT THERE THAT IS GOING TO ASSIST US. BUT SINCE WE HAVE THIS TERM HERE AND IT ISN'T PERFORMING VERY WELL, YOU KNOW FOR US IT'S YOU KNOW WE CAN EXPAND IT AND THEN BRING SOME OF THOSE DOLLARS IN. IT'S NOT REALLY IT'S NOT TOO IMPORTANT THAT WE TAKE THE AT THE MOMENT REALLY THE, THE THE OTHER TWO TAXING ENTITIES BECAUSE, YOU KNOW, WE WANT TO DEVELOP THE PARK AT THE END OF THE DAY AND WE DON'T WANT TO BE HELD, YOU KNOW, BECAUSE THEY PUT SOME CONDITIONS ON THE TERMS THAT WE HAVE NOW. LIKE WE CAN'T DO ANY ECONOMIC DEVELOPMENT TYPE OF THINGS IN THIS TERM. YOU KNOW, THE COUNTY DID THAT. AND SO WE HAVE TO TAKE IT BACK TO THE COMMISSIONERS COURT. AND WE DON'T REALLY WE REALLY DON'T WANT TO BE HELD UP. IF THEY WANT TO PARTICIPATE. FINE. I THINK THE PARK IS GOING TO EVERYBODY'S GOING TO ENJOY IT.

YOU KNOW, PEOPLE THAT LIVE OUTSIDE OF THE TOWN OF HORIZON CITY, WE THINK WE THINK IT'S ONLY FAIR THAT THEY PARTICIPATE AND WE'RE GOING TO ASK SOMEBODY, WE'RE GOING TO WE'RE GOING TO KEEP MOVING TO GET THAT PARK FINANCED. SO HOW DOES THIS TERRORS CREATION INTERACT WITH THE EXISTING TRC? SO I SO THE WAY IT'S GOING TO INTERACT IS IN FUTURE YEARS, WE'LL UTILIZE SOME OF THE DOLLARS THAT ARE BEING PRODUCED TO BRING THEM OVER TO THIS TERM. IN OTHER WORDS, IT'LL BE TWO DIFFERENT, YOU KNOW, THE DECISIONS THAT ARE BEING MADE HERE WON'T NECESSARILY AFFECT THE OTHER SIDE. AND SO PART OF THE. THE THE TERMS STUDY THAT WE'RE DOING NOW IS TO SEE WHAT WORKS BEST, WHETHER WE KEEP THEM SEPARATE OR WE EXPAND THIS ONE.

SO THE TRC, JUST SO YOU ALL KNOW, WAS IT'S LIKE A IT'S LIKE A 100 FOOT BUFFER THAT ABUTS EAST LAKE AND WITH THE CITY UTILIZE THAT TRS TO FUND THE CONSTRUCTION OF EASTLAKE BOULEVARD ALL THE WAY TO HORIZON BOULEVARD. AS PART OF THIS AGREEMENT, THE BUILDER WILL BE REQUIRED TO INVEST A MINIMUM OF 6,000,700 AND $700,000 AND COMPLY WITH THE NOTED DESIGN REQUIREMENTS. THE TOTAL GRANT AMOUNT SHALL NOT EXCEED $40,000 FOR. ECONOMIC DEVELOPMENT. ITEM NUMBER FIVE ON TODAY'S AGENDA IS, AS WALTER JUST MENTIONED, A REQUEST TO APPROVE THE FIRST AMENDMENT TO OUR AGREEMENT WITH NASAL PARTNERS, LLC. THAT WOULD COST IT REPRESENTS $6.7 MILLION OF PRIVATE INVESTMENT IN OUR CITY. PART OF THE REQUIREMENTS ARE THAT THEY HAVE TO GENERATE AT LEAST 51% TENANT USERS IN MEDICAL RELATED. SO SO THIS REALLY IS A MEDICAL OFFICE.

THEY ALSO ARE REQUIRED TO HOST A JOB FAIR THAT WOULD BE HOSTED FROM OUR SITE OUT HERE. AND SO WE WOULD MAKE SURE THAT WE HAVE HORIZON CITY RESIDENTS PLACE UP FRONT FOR ANY JOBS THAT ARE CREATED. THEY SWITCHED ALL THAT AROUND BROUGHT THE BUILDINGS RIGHT UP TO THE FRONT. CLOSE AS CLOSE AS POSSIBLE TO THE PROPERTY LINES. AND DID THE WHOLE LANDSCAPING FURNITURE OUT THERE. IT'S LOOKING REALLY GOOD, BUT THE BUILDER ACTUALLY SHIFTED THE THE BUILDING UP FRONT REVERSE.

AND THIS IS UNBEKNOWNST TO THE THE OWNER, THE DEVELOPER, THEY WEREN'T AWARE OF THAT. SO WE FOUND OUT ABOUT THAT AND WE WENT AND SPOKE WITH THEM. AND HE HE WAS VERY ANGRY ACTUALLY.

HE SWITCHED HIS CONSTRUCTION COMPANY. AND SO WE DIDN'T WANT TO LOSE THE RELATIONSHIP THAT WE HAVE WITH THIS BUILDER. HE'S LOOKING TO INVEST A LOT MORE IN HORIZON CITY, AND HE REALLY DIDN'T MOVE FORWARD WITH THE BEST OF INTENTIONS. AND SO WHAT WE PROPOSED IS TO MAKE SURE THAT THAT BUILDING THAT WAS NOW TURNED WITH THE BACK FACING CANALS DIDN'T LOOK LIKE IT WAS THE BACKSIDE OF THE BUILDING. AND THAT'S WHAT YOU'RE SEEING RIGHT HERE ON SLIDE NUMBER FIVE.

WE'VE ALREADY STARTED ADDING DIFFERENT FEATURES IN THE FRONT THAT WILL KEEP IT FROM LOOKING LIKE THE BACK. I'LL HAVE YOU IF YOU CAN LOOK DOWN AT THE OTHER SLIDE NUMBER SIX ON THE LEFT SIDE. THEY'VE PROPOSED TO MAKE SURE THAT THE FRONT BASICALLY GETS A BUNCH OF NEW THINGS THAT MAKE IT LOOK LIKE A FRONT VERSUS THE BACK, AND WE LOCK THAT IN IN AN EXHIBIT. SO IF YOU CAN GO OVER TO PAGE NUMBER FOUR, SLIDE NUMBER SEVEN, THAT'S SPECIFICALLY WHAT WE'RE GOING TO ADD NOW TO THE AGREEMENT. SO SO IN TERMS OF THE MECHANICS OF THE AGREEMENT, WHAT WE'RE GOING TO DO IS WE'RE GOING TO SWAP OUT THE CURRENT EXHIBIT AND BRING THIS ONE IN THERE.
