THIS IS ON AN UPDATE ON THE CAPITAL IMPROVEMENT PROGRAM. GOOD EVENING. COUNCIL. MR. CITY MANAGER, LET ME FIRST START BY SAYING THAT THIS IS THE LAST CIP REPORT THAT I WILL BE MAKING TO THE COUNCIL. MY TIME AT HORIZON HAS COME TO AN END AND SO I'M ON TO OTHER PURSUITS AND OTHER INTERESTS. BUT IT HAS BEEN A REAL HONOR TO WORK WITH YOU, WITH VARIOUS COUNCILS, WITH YOUR STAFF, AND TO TRY TO MAKE AN IMPACT ON THIS COMMUNITY. SO AGAIN, THANK YOU FOR THE OPPORTUNITIES. ALL RIGHT. WE WEREN'T GOING TO MAKE IT EASY ON YOU FOR THE LAST ONE, I GUESS NOT. SO FOR THE MUNICIPAL FACILITIES. A PUNCH LIST WALK THROUGH HAPPENED YESTERDAY MORNING. AS I UNDERSTAND IT, THERE WERE SOME MINOR ELEMENTS THAT WERE STILL MISSING. THERE WERE [00:10:03] MOSTLY COSMETIC, ALTHOUGH THERE IS A REPAIR THAT HAS TO HAPPEN DUE TO A MISHAP THAT OCCURRED ON THE SITE AND THAT THE CONTRACTOR IS TAKEN CARE OF. THE GAS INSTALLATION IS HAPPENING THIS WEEK, AND LANDSCAPE AND IRRIGATION ARE ONGOING. WE'RE WE'RE PENDING PLANTS. THESE ARE SOME OF THE IMAGES. ALL OF THESE IMAGES ARE FROM THE CONTRACTOR. THEY WERE TAKEN ON DECEMBER 4TH. BUT YOU CAN SEE THE FINISHED INTERIOR. I HAD TO USE SOME OF THE NOT SO ATTRACTIVE AREAS AS WELL TO SHOW YOU WHAT IT LOOKED LIKE. AND THIS IS THE OUTSIDE. IT'S THE ONE THAT HAS THE LEAST SHAPE. BUT THAT'S WHAT THEY'RE THEY'RE WORKING ON TO COMPLETE THE PROJECT. UNDER FEDERAL AND STATE FUNDED PROJECT UPDATES. WE'LL START WITH NORTH DARLINGTON RECONSTRUCTION. WE HAVE SOME PRETTY SIGNIFICANT NEWS THAT THE CITY IS GOING TO HAVE TO EVALUATE INTERNALLY AND AND MAKE A RECOMMENDATION TO TEXDOT. TEXDOT AND THE CONTRACTOR ARE PROPOSING AN EIGHT WEEK CLOSURE ON DARINGTON BETWEEN HOMESTEAD TO HORIZON BOULEVARD, BEGINNING AFTER THE HOLIDAYS. THEIR RECOMMENDATION IS BASED ON SEVERAL FACTORS. ONE IS THAT THIS WILL ALLOW FOR CONTINUED PROGRESS ON THE MAJOR ELEMENTS. ABSENT THE CLOSURE. WHAT WILL HAPPEN IS THAT ONLY THE SUBCONTRACTORS WILL BE WORKING IN THE MAJOR ELEMENTS, SUCH AS THE WATER LINE AND STORM SEWER INSTALLATION WILL BE HAMPERED. THIS CLOSURE ALSO ALLOWS FOR BOTH THE CONTRACTOR, JORDAN FOSTER AND TEXAS GAS CONTRACTOR TO WORK IN THE AREA. AS YOU KNOW, THERE ARE CAPS THAT HAVE TO BE REMOVED. TEXAS GAS SERVICE IS NOT CERTAIN ABOUT HOW MANY LINES THEY WILL HAVE TO REMOVE, BUT THE COMPLETE CLOSURE PROVIDES FOR GREATER SAFETY SINCE THE ENTIRE AREA WILL BE CLOSED. THIS CLOSURE ALSO ALIGNS WITH THE CONSTRUCT ALIGNMENT CONSTRUCTION SCHEDULE. WITH WEATHER RELATED CONSTRAINTS, THERE'S PAVING THAT CANNOT OCCUR WHEN IT'S COLD. TEMPERATURES HAVE TO BE AT A CERTAIN LEVEL FOR THE PAVEMENT TO CURE, AS IT SHOULD. AND SO THIS ALLOWS FOR SOME OF THAT WORK TO HAPPEN. AND THEN THE THE WORK THAT REQUIRES THE WARMER TEMPERATURES CAN OCCUR IN THE SPRING. ULTIMATELY, THIS PROVIDES A SAFER ENVIRONMENT FOR THE WORK FOR THE CONTRACTORS BECAUSE THEY DON'T HAVE TO WORRY ABOUT THE TRAVELING PUBLIC. WE JUST LEARNED ABOUT THAT, THIS PROPOSAL THIS MORNING. SO AGAIN, THE CITY WILL HAVE TO EVALUATE AND MAKE A RECOMMENDATION. BUT I CAN TELL YOU THAT WHEN WE ASKED THEM IF THERE WAS AN OPTION, WHAT HAPPENS IF THIS DOES NOT GET APPROVED? THE OPTIONS WERE NOT GOOD. IT COULD BE A POTENTIAL STOP TO THE PROJECT, WHICH OF COURSE THEN BRINGS ON COSTS FOR FOR DELAYING THE PROJECT. SO AGAIN, THIS IS SOMETHING THAT THAT WILL HAVE TO BE EVALUATED. BUT WE WANTED TO MAKE SURE THAT THE COUNCIL WAS AWARE THAT THIS WAS WAS COMING. TXDOT WANTS TO KNOW SOONER RATHER THAN LATER WHAT THE DETERMINATION WILL BE SO THAT THEY CAN ADVISE THE TRAVELING PUBLIC AND AND LET THEM KNOW THAT THAT IT WILL BE A FULL CLOSURE OF NORTH DARRINGTON. IT'S CERTAINLY A JARRING NUMBER TO LOOK AT. IT'S NOT EASY TO DIGEST, BUT AGAIN, IT SEEMED TO ME THAT THAT THE SCHEDULER FOR JORDAN FOSTER HAD MADE SOME CAREFUL ANALYSIS OF WHAT HAD TO HAPPEN. SO THOSE ARE THE COMMENTS THAT I OFFER. AS FAR AS UTILITY CONFLICTS. YOU HAVE ANOTHER ITEM ON TODAY'S AGENDA, WHICH IS THE FINAL REIMBURSEMENT AGREEMENT. I KEPT THE HISTORY. THE MOST RECENT UPDATE FOR THE COST IS $170,736, WHICH TO ME IS A VERY PRECISE NUMBER. AND YET, TEXAS GAS SERVICE IS PARTICULARLY CONCERNED THAT IT MIGHT BE MORE I DON'T KNOW THAT THEY'VE SAID THAT IT COULD BE LESS, BUT THEY'VE CERTAINLY SAID THAT IT COULD BE MORE. SO THEY HAVE. TEXAS GAS SERVICE HAS AGREED TO THE AGREEMENT THAT THAT THE CITY HAS REVISED, AND THEY SENT BACK SOME COMMENTS. I UNDERSTAND THAT MISS FIRTH HAS REVIEWED THOSE. WE'RE STILL PENDING SOME OF THE EXHIBITS TO ALLOW FOR THAT TO BE FINALIZED. AND AGAIN, THIS IS SOMETHING THAT THE COUNCIL WILL BE CONSIDERING THE THE AGREEMENT ALSO INCLUDES THE CONTINGENCY AMOUNT SO THAT IF THERE IS MORE, THE MAYOR HAS THE AUTHORITY TO TO MOVE ON THAT WITHOUT NECESSARILY HAVING TO TO COME BACK TO COUNCIL. AND THERE ARE THERE'S A PERCENTAGE AS FAR AS UTILITY CONFLICTS. AGAIN, I KEPT SOME OF THE HISTORY THAT WE PRESENTED BEFORE. TEXDOT IS REVIEWING THE REVISED PLAN THAT WAS PROVIDED ON OCTOBER 22ND, BUT THE WORK IS ON HOLD PENDING THE CAP REMOVAL, WHICH AGAIN TIES BACK TO THE TEXAS GAS [00:15:03] SERVICE. UTILITY CONFLICTS. AND ON THE POND TREATMENT. I'M SORRY THAT THIS DOESN'T HAVE THE THE. THE FORMATTING THAT I WOULD HAVE LIKED. THE GEOTECHNICAL RECOMMENDATIONS HAVE BEEN FORWARDED TO TEXDOT AND TO THE CONTRACTOR. SO THEY HAVE THAT FINAL REPORT THAT THE CITY COMMISSIONED. EXCUSE ME. AND ON THE SHARED USE PATH, I BELIEVE THAT THE THE OPTIONS TO ADDRESS THE ROCK WALL ARE STILL ONGOING. RODMAN SHARED USE PATH. THE PROJECT IS ON HOLD PENDING ARRIVAL OF THE BOLLARDS. WE'RE TOLD THAT THEY'RE BEING MANUFACTURED. THE CONTRACTOR HAS PICTURES OF THEM. SO HE BELIEVES THAT THAT THOSE WILL ARRIVE SHORTLY AFTER THE HOLIDAYS, BUT THEY DON'T HAVE A FINAL SCHEDULE YET. WE DID RECEIVE AN UPDATE THIS AFTERNOON. AND SO AGAIN, THERE'S THERE'S SUBMITTALS THAT HAVE BEEN APPROVED BY TXDOT. AND REALLY ALL PENDING IS, IS THE ARRIVAL OF THE BOLLARDS. EXCUSE ME. AS FAR AS FUNDING UPDATES, HOWARD LOW PEDESTRIAN PATH. WE REPORTED RECENTLY THAT IN NOVEMBER, THE TEXAS TRANSPORTATION COMMISSION APPROVED THIS PROJECT, AND WE'RE ANTICIPATING TRANSPORTATION DEVELOPMENT CREDITS TO COVER THE CITY MATCH. THE NEXT STEPS ARE THE ADVANCED FUNDING AGREEMENT THAT WILL BRING THE MONEY TO THE CITY AND OUTLINE THE CITY'S RESPONSIBILITIES. THAT'S EXPECTED IN LATE SPRING OF 2026 AS AS COUNCIL MAY RECALL, THE ADVANCE FUNDING AGREEMENTS ARE PRETTY FORMULAIC. IT'S TXDOT'S WAY. AND IN THE CITY WE'LL DEVELOP THE PLAN FOR EXECUTION AGAIN. AS COUNCIL MAY RECALL, THE PLAN HAD BEEN TO CONTRACT WITH CAMINO REAL REGIONAL MOBILITY AUTHORITY BECAUSE THEY CAN DELIVER FEDERALLY FUNDED PROJECTS IN ACCORDANCE WITH FEDERAL REQUIREMENTS. BUT THAT, AGAIN, WILL BE SOMETHING THAT'S LEFT TO TO THE CITY. ON TEARS AND TODD DILLEY, THE LAKE AND TRANSIT PLAZA CITY STAFF, THE CITY ENGINEER AND ETA WHICH IS THE THE THE TRANSIT PROVIDER HAVE REVIEWED THE 30% DESIGN AND THE 30% DESIGN FOR THE TRANSIT PLAZA. AND I JUST WANT TO MAKE THIS COMMENT. ONE OF THE COMMENTS THAT WE MADE WAS NOT ONE OF THE MAJOR COMMENTS WAS TO INCLUDE A BICYCLE REPAIR STATION. I REMEMBERED THAT COUNCIL HAD EXPRESSED INTEREST IN THAT. FOR HOWARD LOWE. THERE'S AN OPPORTUNITY TO INCLUDE IT INTO THE AND I UNDERSTAND IT'S REALLY A SMALL ELEMENT, BUT IT FOSTERS A MULTIMODAL CONCEPT THAT THAT THE CITY WANTS TO FOSTER WITH THIS PROJECT. THE MORE IMPORTANT ASPECTS ARE THAT WE'RE AUGMENTING THE SCOPE TO ACQUIRE PROPERTIES THAT ARE REQUIRED FOR PONDING AREAS. AND I THINK I'VE MADE THIS COMMENT BEFORE TO COUNCIL. I WANT TO EMPHASIZE IT BECAUSE THE CITY HAS RECEIVED FEDERAL DOLLARS FOR THIS PROJECT. THE ENTIRE PROJECT IS FEDERALIZED. SO ALTHOUGH NOT 100% OF THE PROJECT IS FUNDED WITH FEDERAL DOLLARS, EVERYTHING, ALL OF THE ACTIVITIES ASSOCIATED WITH THE PROJECT MUST COMPLY WITH FEDERAL REQUIREMENTS. SO WHAT STAFF IS PROPOSING IS AN INTERLOCAL AGREEMENT WITH CAMINO REAL REGIONAL MOBILITY AUTHORITY TO ACQUIRE THE NECESSARY PROPERTIES FOR THE DRAINAGE POND. IF I MAY REMIND COUNCIL, SOME OF YOU MAY RECALL THIS, BUT OTHERS WHO WHO ARE NEW TO COUNCIL MAY NOT BE AWARE. SO THE CITY CONTRACTED WITH CAMINO REAL REGIONAL MOBILITY AUTHORITY TO ACQUIRE THE PROPERTIES FOR THE NORTH DARRINGTON POND, WHICH IS AT THE NORTH END OF THE TOD AREA. THEY WERE QUITE SUCCESSFUL WITH ALL OF THE ACQUISITIONS. WE DID GO TO EMINENT DOMAIN FOR THREE PROPERTIES, BUT THE REASON FOR THAT EMINENT DOMAIN WAS THAT WE COULD NOT GET CLEAR TITLE. AND THE ONLY WAY TO CLEAR THAT TITLE FOR THE TOWN WAS TO GO THROUGH THE EMINENT DOMAIN PROCEEDINGS. AND THEN NOW WE'VE ADDED THE WATER TIE IN AS WELL AS FAR AS THEIR PROJECT MANAGEMENT AND CONSTRUCTION OVERSIGHT OF THOSE SERVICES. ALSO, THE EASEMENT THAT YOU SAW EARLIER, THEY ALSO INCLUDED THAT IN HERE. AS FAR AS THE COST, THAT'S GOING TO BE A TOTAL OF ABOUT $25,000, AND THAT WILL COVER ALL THOSE ADDITIONAL SERVICES THAT THEY PROVIDED TO MAKE SURE THAT WATER AND SEWER CONSTRUCTION WENT UNDERWAY, AS WELL AS THE WATER TIME. AND NOW WE'RE ADDING AN ITEM THAT WAS PREVIOUSLY HEARD BY THE COUNCIL FROM DOCTOR CASADA, WHICH IS THE GAS CAPS. YOU'VE HEARD ABOUT THAT. SO THE GAS CAPS ARE ESSENTIALLY ABOUT A FOOT AND A HALF TO TWO FEET IN WIDTH. THEY'RE PRETTY THICK CONCRETE COVERS. AND WHAT THEY DO IS THEY THEY WERE DESIGNED TO PROTECT THE THE LINES THE GAS LINES. RIGHT. AND THEY'RE PLACED MOSTLY IN THE AREAS OF CROSSINGS. RIGHT. AND I'LL SHOW YOU EXACTLY WHICH ONES WE'RE TALKING ABOUT. THERE'S A TOTAL OF FIVE OF THEM THROUGH DARRINGTON THAT NEED TO BE ADDRESSED. SO WE ADDED A 2,020% CONTINGENCY ON TOP OF THIS TO TO SATISFY THEIR, THEIR, THEIR CONCERNS THAT THEY HAVE. OVER THESE GAS CAPS. SO THIS IS THE FIRST GAS CAP. THIS IS ON DARRINGTON ROAD IN ROSSLYN. AND AGAIN IT'S MOSTLY ON THE CROSSINGS. AND THEN THIS ONE IS ALONG DARRINGTON AND JASPER. AGAIN, THE CROSSES. AND THEN THIS ONE HERE IS ON DARRINGTON ROAD AND ALDERWOOD MANOR DRIVE. THAT'S WHY THEY HAVE TO REMOVE THAT. SO IN ORDER FOR THEM TO REMOVE THAT NOW IT'S GOING TO EXPOSE THOSE LINES UNDERNEATH. THOSE ARE THE SECTIONS THAT THEY'RE GOING TO CUT OFF BEFORE. PRIOR TO THIS, TEXAS GAS WAS EVEN RECOMMENDING REMOVAL OF THE ENTIRE LINE ITSELF. BUT THEY DON'T NEED TO DO THAT. THEY ONLY NEED TO DO THAT AT THOSE INTERSECTIONS. SO THAT WAY THEY CAN HIT ELEVATION RESOURCES. SO. INCREDIBLE. IT'S UNDER US. YEAH. AND AND AGAIN THESE ARE, THESE ARE THINGS THAT WE HAVE NO CLUE REALLY THAT THEY WERE THERE UNTIL THEY STARTED DOING THEIR EXCAVATIONS. I MEAN, AT THE TIME THAT'S HOW THEY CONSTRUCTED. YEAH. AND THEY WERE, AS MR. RUBIO SAYS, THEY WERE DONE BACK IN THE 50S, 40S AND, AND 50S WHERE THEY DID IT RIGHT. THEY THOSE CONCRETE SLABS ARE SOLID. THEY'RE SOLID. THERE IS YEAH. THERE'S NO LINES. YEAH. YOU KNOW, AS WE SPOKE PREVIOUSLY IN OCTOBER, THERE WAS AN ITEM IN EXECUTIVE SESSION THAT WE DID DISCUSS THE POSSIBILITY OF CREATING ANOTHER TERRORS. AND SO WHAT I'M BRINGING TO YOU TODAY IS THIS IS THE THE CONSULTANT SERVICES AGREEMENT THAT THE HORIZON EDC IS GOING TO TAKE AND AND SIGN THAT EXECUTE THAT AGREEMENT ON BEHALF OF THE CITY. BUT ONE OF THE THINGS THAT WE DISCUSSED, YOU KNOW, THE MAYOR AND THE EDC WAS THE POSSIBILITY OF ADDING THE TRANSIT ORIENTED DEVELOPMENT, ALSO THE ONE THAT'S ACROSS THE STREET INTO THE TERRORS TO EXPAND THAT TOURISM. AND SO WE'RE GOING TO DO THAT AS PART OF THIS EXERCISE WITH THIS CONSULTANT TO SEE IF WE CAN GENERATE ADDITIONAL DOLLARS FOR THE TRANSIT ORIENTED DEVELOPMENT. I THINK IT'S IMPORTANT THAT WE ALSO CALIBRATE THE THE TOD THAT WE HAVE RIGHT NOW, THE TOURS THAT'S IN THE TOD, SO THAT WE ENSURE THAT WE'RE GETTING A GOOD MEASURE ON WHAT THOSE DOLLARS ARE GOING TO LOOK LIKE THERE IN THE FUTURE. SO WE'LL BE ABLE TO DO THAT WITH WITH THIS AGREEMENT THAT WE'RE PROPOSING TO, TO EXECUTE HERE. THIS IS NOT AN OFFICIAL RFP OR RFQ. THIS IS JUST SOMETHING THAT WE GOT WHEN WE WENT OUT. AND WE GOT THREE QUOTES THAT'S REQUIRED BY YOUR YOUR PROCUREMENT POLICY THAT YOU HAVE IN PLACE THAT'S REQUIRED BY BY THE CITY. AND SO WE USE THAT. RIGHT. BECAUSE IT'S UNDER $50,000. AND SO THE OTHER THING THAT WE LOOKED AT IS HOW QUICKLY CAN THIS CONSULTING COMPANY PROVIDE THIS INFORMATION TO US?
